Welcome to flick-it! These Terms of Service govern your access to and use of our platform, including all features, services, and content provided. By using flick-it, you agree to these terms. If you do not agree, please refrain from using our app.
Account Responsibilities and Violations
Account Registration
To access the entire app features, you must create an account. You agree to provide accurate, current, and complete information, including but not limited to the following examples.
- Age: This will be used to ensure you meet the age requirements, but may also be used for additional purposes as described in our Privacy Policy.
- Email: This will be used for logging in purposes, email confirmations, and other account or app-related communications, but may also be used for other purposes in line with our Privacy Policy.
Account Security
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. flick-it is not liable for any unauthorized access to your account unless it is directly caused by negligence on our part. Users are encouraged to take necessary precautions to safeguard their accounts.
Account Termination
Users agree to comply with all applicable laws and regulations while using the app.
We reserve the right to take action, including suspension or termination of accounts, if users violate our Terms of Use. This includes, but is not limited to, the following violations:
- Providing false, inaccurate, or outdated information during registration.
- Participating in fraudulent activities
- Harming the community in any way
- Uploading offensive or sensitive content, including images or materials that exploit, harm, or pertain to individuals, including children and adults, in an inappropriate or illegal manner.
Such actions are strictly prohibited and may be reported to the appropriate authorities, in accordance with applicable laws. Users are responsible for ensuring that all content they upload complies with our policies and community standards.
User-Generated Content
Content Restrictions
You agree not to upload content that is unlawful, abusive, defamatory, infringes on intellectual property rights, or includes offensive or sensitive materials. This includes, but is not limited to, content that exploits, harms, or involves individuals—whether children or adults—in an inappropriate or illegal manner. We reserve the right to remove such content and take further action as necessary.
Ownership of Content
You retain ownership of the content you post on flick-it. By posting content on the platform, however, you grant flick-it a non-exclusive, royalty-free, worldwide, perpetual, and transferable license to use, modify, distribute, publicly display, and create derivative works of your content for operational and promotional purposes.
Prohibited Content
Sensitive or exploitative materials, including any related to minors and adults, are strictly prohibited and will result in immediate account termination and reporting to the appropriate authorities. This includes content that is unlawful, abusive, defamatory, infringes on intellectual property rights, or contains offensive or sensitive materials, particularly content that exploits, harms, or involves individuals—whether children or adults—in an inappropriate or illegal manner. We reserve the right to remove such content and take further action as necessary, including reporting such content to relevant authorities.
Responsibility for Content
You are solely responsible for the content you post and any consequences that arise from it. By posting content, you confirm that you own or have obtained the necessary rights, permissions, or licenses to share it on flick-it. We do not endorse or take responsibility for user-generated content.
Reporting Content
If you come across content that violates these terms, please report it using our in-app reporting tool or contact us at support@flick-it.org. We will review reported content and take appropriate action, which may include removal of the content and, where necessary, further investigation or legal action.
Privacy and Data Use
Your content and account information are subject to our Privacy Policy. By using flick-it, you consent to the collection, storage, and processing of your data in jurisdictions where our servers or third-party servers (such as Firebase) are located. You acknowledge that data protection laws in these jurisdictions may differ from those in your country of residence. For more details, refer to our Privacy Policy.
Disclosure to Authorities
We may disclose your information, including personal data and account details, to law enforcement, government authorities, or other third parties if required to do so by law, legal process, or if such disclosure is necessary to:
- Comply with legal obligations.
- Protect the rights, property, or safety of flick-it, our users, or the public.
- Prevent or investigate potential violations of our Terms of Use, fraud, or other unlawful activities.
Data Retention
We retain user data for as long as necessary to fulfill the purposes outlined in our Privacy Policy or as required by law. Upon request, we may remove your personal data, including account details and associated content, subject to the following exceptions:
- Comments and Interactions: If your data includes content (such as comments) associated with other users’ interactions, those related interactions may be retained to preserve the integrity of the platform’s content.
- Compliance with Laws: Certain data may be retained to comply with legal obligations, enforce our Terms of Use, or resolve disputes.
- Content Removal: Images and other media you upload may be removed at your request. However, related content, such as comments or metadata, may remain visible unless.

Disputes Over Content
If you believe your content has been used without permission or violated, contact us at support@flick-it.org. We will address disputes in accordance with applicable laws. flick-it reserves the right to mediate or refuse mediation of disputes at its sole discretion.
Legal and Dispute Resolution Terms
Mediation Clause
All disputes arising from or relating to these Terms shall first be resolved through good faith mediation. The parties agree to engage in mediation administered by a mutually agreed-upon mediator or mediation service. Mediation shall take place in Merced County or virtually, as agreed upon by both parties, and the costs of mediation shall be shared equally by both parties. If mediation fails to resolve the dispute, either party may pursue resolution through litigation in accordance with applicable laws.
Indemnification
You agree to indemnify and hold flick-it harmless from any and all claims, damages, or expenses arising from your use of the app. This includes, but is not limited to, claims related to your content, account usage, actions taken to earn points, accessing restricted or prohibited areas (including private property), interactions with third-party services (such as Firebase), or any other activities conducted through the app. Your responsibility extends to ensuring compliance with all applicable laws, respecting the rights of others, and understanding the terms and policies of any third-party services integrated with flick-it.
Limitation of Liability
flick-it is not liable for any indirect, incidental, or consequential damages, including loss of data, reputation, or profits, arising from use of the platform. flick-it makes no warranties or representations regarding the accuracy or completeness of content or services on the platform, which are provided “as-is” to the maximum extent permitted by law.
Force Majeure
flick-it is not liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, cyberattacks, strikes, government actions, war, pandemics, failures of third-party services, or any other events beyond our control. In such cases, flick-it reserves the right to suspend or terminate affected services without liability.
Modifications to Terms
We may update these Terms from time to time. Users are responsible for reviewing updates, and continued use of flick-it after updates constitutes acceptance of the new terms. Updates will be communicated through the app or email.
